Personal data protection policy

Zavod Novo Mesto recognises and respects the privacy of its visitors and handles their personal data responsibly, carefully and in accordance with the regulations and internal policies and procedures applicable in the Republic of Slovenia and the European Union. Access to personal data is granted only to authorised staff and contracted data processors, to the extent and for the purposes strictly necessary for the smooth performance of work processes, the provision of services and the exercise of rights and obligations arising from contractual relationships with customers.

We undertake not to sell, lend or otherwise disclose personal data provided via the website or by any other means to third parties. All data will be treated as confidential and used solely for internal records and for the purpose for which they were provided. Your data will be carefully protected against loss, misuse, unauthorised access, disclosure, alteration or destruction.

Zavod Novo Mesto collects personal data from various sources. In most cases, the data are provided directly by visitors who choose to use our services (such as purchasing tickets for events or registering to attend a conference). Data are also collected at events and through subscriptions to news updates.

Individuals may contact the data protection officer directly regarding all matters relating to the processing of their personal data and the exercise of their rights under the applicable data protection legislation.

Types of personal data collected and processed

In the course of its activities, Zavod Novo Mesto collects and processes the following types of personal data: name, contact details (address, email address, telephone number), website cookies, password in encrypted form, IP address of the device used to access the service, status (such as student, pensioner or membership of professional associations) for the purpose of applying discounts, and other data entered in registration forms for specific events. Zavod Novo Mesto is not responsible for the accuracy of data entered by users.

Zavod Novo Mesto maintains records of personal data processing activities, which include the types of personal data and the purposes of their processing.

Legal bases and purposes of personal data processing

1. Processing for the performance of services: Zavod Novo Mesto processes personal data for the purpose of providing services, i.e. fulfilling orders (notifications about the date and time of events, sending informational materials and invoices, other matters relating to the order), monitoring customer satisfaction (including complaints), and other necessary communication in connection with the order through various channels.

2. Processing based on consent: Processing of personal data may also be based on the individual’s consent, which allows Zavod Novo Mesto to use the individual’s personal data for the purposes specified in that consent, in particular:

  • general news, including information on new developments, benefits, offers, invitations to events, participation in prize draws and surveys and research;

  • tailored offers of services and other new developments, benefits, offers and invitations to events, participation in prize draws, including for the purpose of segmentation;

  • personally tailored offers, where Zavod Novo Mesto will, on the basis of an individual analysis of purchasing habits, past purchases, interests and personal characteristics (in particular analysis and evaluation of the opening of emails, clicks on links and interactions with media) and survey responses, create a personal profile and provide services accordingly.

If an individual does not give consent for the purposes of processing personal data listed above, gives it only in part or withdraws that consent (in whole or in part), Zavod Novo Mesto will communicate with that individual only in the cases and to the extent permitted by the consent given or as permitted by applicable legislation (e.g. general information, fulfilment of obligations to provide information about a product or service used by the customer).

The provision of services is not conditional on giving consent. Consent is voluntary, and if an individual decides not to give it or subsequently withdraws it, this does not in any way reduce the rights arising from the contractual relationship or result in any additional costs or other disadvantages for the individual.

Withdrawal of consent

Consent is given for the purposes defined at the time it is granted and remains valid until withdrawn. When consent is withdrawn in whole or in part, Zavod Novo Mesto will no longer process the data for the purposes to which the withdrawal relates

Withdrawal may be submitted to Zavod Novo Mesto in the same form in which consent was given (via the website or in writing to the address of Zavod Novo Mesto or by an oral request recorded at the office of Zavod Novo Mesto). Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Individuals may also unsubscribe from communications from Zavod Novo Mesto via the channel through which they received them. A link to unsubscribe or information on how to unsubscribe is included in the communication. The request will be recorded in the system and implemented without delay and at the latest within fifteen days of receipt.

Categories of personal data users

The users of personal data are the staff, authorised partners and contracted data processors of Zavod Novo Mesto, who are bound, under employment legislation, personal data processing agreements or confidential information protection agreements, to respect and protect individuals’ personal data. More detailed information on the categories of users, contractual partners and contracted data processors may be obtained on request from the data protection officer of Zavod Novo Mesto.

The contracted data processors with whom we cooperate are primarily:

  • providers of accounting services and other providers of legal and business advisory services;

  • infrastructure maintenance providers (video surveillance, security services);

  • information system maintenance providers;

  • providers of email services and providers of software and cloud services (e.g. Arnes, Microsoft, Google);

  • providers of social media and online advertising services (Google, Facebook, Instagram, etc.).

Users access the data in accordance with the assigned data access rights.

Zavod Novo Mesto also discloses personal data to third parties where such a disclosure or transmission is required by law (for example the Financial Administration of the Republic of Slovenia, courts, the police, etc.).

Zavod Novo Mesto will not, under any circumstances, disclose an individual’s personal data to unauthorised third parties. Contracted data processors may process personal data only within the scope of the instructions of Zavod Novo Mesto and may not use personal data for any other purposes.

Zavod Novo Mesto, as controller, and its staff do not transfer personal data to third countries (outside the Member States of the European Economic Area – the Member States of the European Union and Iceland, Norway and Liechtenstein) or to international organisations, except to the United States, where relationships with contracted data processors in the United States are governed by standard contractual clauses (model contracts adopted by the European Commission) and/or binding corporate rules (adopted by an organisation and approved by supervisory authorities in the European Union).

For the purposes of better oversight and control of contracted data processors and the proper regulation of contractual relationships, Zavod Novo Mesto maintains a register of contracted data processors, which lists all specific contracted data processors with whom the organisation cooperates.

Data retention

The retention period for personal data depends on the legal basis and the purpose of the processing of each category. Personal data are retained only for as long as necessary to achieve the purpose for which they were collected or further processed. After the purpose of the processing has been fulfilled, personal data are deleted, destroyed, restricted or anonymised, unless another legal basis exists or this is necessary for the establishment, exercise or defence of legal claims.

Rights of customers

Zavod Novo Mesto ensures that individuals whose personal data it processes are able to exercise their rights, namely:

  • the right of access to personal data collected in relation to them;

  • the right to rectification, whereby Zavod Novo Mesto shall correct inaccurate personal data relating to them without undue delay;

  • the right to erasure, whereby Zavod Novo Mesto shall delete personal data relating to them without undue delay where one of the following grounds applies: (1) the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, (2) the individual withdraws the consent on which the processing is based and there is no other legal basis for the processing, (3) the individual objects to the processing and there are no overriding legitimate grounds for the processing, (4) the personal data have been processed unlawfully, (5) where so provided by law;

  • the right to restriction of processing, where one of the following applies: (1) the individual contests the accuracy of the data, for a period enabling Zavod Novo Mesto to verify the accuracy of the personal data, (2) the processing is unlawful and the individual opposes the erasure of the personal data and requests the restriction of their use instead, (3) Zavod Novo Mesto no longer needs the personal data for the purposes of the processing, but they are required by the individual for the establishment, exercise or defence of legal claims, (4) the individual has objected to the processing pending verification whether the legitimate grounds of the controller override those of the individual. Where processing has been restricted in accordance with the preceding paragraph, such personal data, with the exception of storage, shall only be processed with the consent of the individual to whom they relate or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person. Zavod Novo Mesto must inform the individual before lifting the restriction of processing.

An individual may submit a request in a manner that allows identification, namely by an oral request recorded at the office of Zavod Novo Mesto (Novi trg 5, 8000 Novo Mesto), by a written request or by a request submitted by electronic mail. A request relating to data provided on the basis of consent must be submitted in the same form in which the consent was given.

Requests received are handled by the data protection officer. Zavod Novo Mesto must respond to a request without undue delay and at the latest within one month.

Zavod Novo Mesto provides the requested information to the individual free of charge. Where requests are manifestly unfounded or excessive, in particular because they are repetitive, Zavod Novo Mesto may (1) charge a reasonable fee, taking into account the administrative costs of providing the information or communication or taking the action requested, or (2) refuse to act on the request.

Objection in the event of an incomplete decision by the controller and the right to lodge a complaint with the supervisory authority

If an individual considers that the personal data received on the basis of a request to exercise their rights under the previous section of this General Information are not those requested or that not all requested personal data have been received, the individual may, before lodging a complaint with Zavod Novo Mesto, submit a reasoned objection within fifteen days. Zavod Novo Mesto shall decide on the objection within five working days.

An individual may lodge a complaint with the supervisory authority in the event of the controller’s failure to act (that is, if Zavod Novo Mesto does not respond to the individual’s request to exercise their rights within one month).

A complaint may be lodged against a negative decision of the controller, for the resolution of which the supervisory authority is competent. The individual may lodge the complaint with the controller within fifteen days of receipt of the controller’s response.

In exercising rights under this heading, or where the individual considers that their rights have been infringed, they may seek protection or assistance from the supervisory authority, namely the Information Commissioner (website: https://www.ip-rs.si/).

Use of the website

When visiting the website, certain data (IP address, date, time, the address of the page from which you access the website) are stored on the server. These data are anonymous and are used solely for statistical processing.
